Overview

Section 97 of the Mining Act empowers the Minister to grant Permission for a Geophysical and Geological Survey. Basically application for permission is based on some new or special concepts that need to be tested on a Reconnaissance level. The objectives can be based on geological hypotheses, the need to obtain regionalised information, etc.

There is no fixed format for these Permissions; however, an application will have to contain some fundamental elements such as an elaboration of the geological objectives and program, the area(s) of interest, proposed fees and scheduling. The technical and financial capability of the applicant will also be considered.

Requirements

  1. Application (letter) to the subject Minister 
  2. Work program and Budget
  3. Proof of Financial and Technical Capability
  4. Proposal for the application and granting of PL- delivery
  5. Maps (Geological and Property Status)
  6. Archival Geological Data
  7. Specified minerals of interest

Procedure 

  1. Upon receipt of the application at the Land Management Division (LMD), subject to the instructions of the LAM, AO prepares the file and forwards it to the Cartographic Section for verification and input in the database
  2. Following verification, AO then forwards the application to the Geological Services or Petroleum Division through LAM to review WP, terms and conditions and fee structure.
    • If the Geological Services Division (GSD) is satisfied with the terms set out in the application, the same is returned to the LMD with an approved summary to be tabled to the subject Minister. This summary includes the recommendation of the GSD and must be signed by the MGS.
    • If the GSD is not satisfied with the terms set out in the application, the same is indicated to the Commissioner, who provides the requisite guidance to the LAM for next actions.
  1. Providing condition at 2(a) is met, a summary and recommendation are forwarded to the subject Minister for consideration and approval. The same is signed by the Commissioner.
  2. If the application is approved by the subject Minister, a reservation Order is prepared by the AO and sent for review by the Legal Advisor.
  3. Upon return of the Order from Legal Advisor, AO modifies where necessary and forwards it to LAM for review.
  4. The order is forwarded for the Commissioner’s review and then sent on to the subject Minister for signature.
  5. If the order is signed by the subject Minister, the same is sent for publication.
  6. Once published in the Official Gazette, AO notifies the applicant to make the first-year payment. 
  1. Upon receipt of the first year rental payment, Permission is prepared by AO and forwarded to GSD for review.
  2. The applicant is notified to visit the LMD for the signing of the Permission.
  3. LAM reviews Permission
  4. Permission is forwarded for the signature of the Minister, while the Commissioner signs as recording Permission.
  5. Applicant is advised in writing to uplift the Permission.
  6. Applicant uplifts Permission.
    NB: A duplicate is kept by the Commission, which must be signed by the applicant upon receipt of the original.
  7. Records and databases are updated by AO/Designated Cartographic staff to reflect the issuance of Permission
