Documents to be presented before any transaction can be completed with the GGMC

Overview

A permit holder shall not be free to transfer the rights, title, interest and obligations to any Mining Permit or any part thereof, or share, or create any interest whatsoever therein, without first obtaining the consent in writing of the Commission. 

For an MP to be transferred, the Permit must be in good standing with respect to rental payment and environmental bond.

Who can apply for an MP?

The holder of a PPMS must also be one of the following:

  1. An individual who is a citizen of Guyana and an adult
  2. A partnership consisting of two or more citizens of Guyana
  3. A company whose entire issued share capital is beneficially owned by citizens of Guyana or by a corporation which has been established by or under a written law in operation in Guyana, or partly by such citizens and partly by such a corporation
  4. A co-operative society registered under the Co-operative Societies Act
  5. A public corporation, or any other corporate body established by or under any written law in force in Guyana
  6. Any organization established by the Government or by or under any written law in force in Guyana and authorized to carry on mining operations

Requirements

Mining Permit holder(s) must submit an application to the Commissioner requesting for transfer. The application must provide the following details:

  1. Completed application Form 5F.
  2. Map and coordinate-referenced description of the area of interest
  3. Payment of application fee ($2,000 per application)
  4. Payment of a deposit on the first  year’s rental (calculated at US$1.00 per acre) 
  5. Registration or Incorporation documents if the applicant is a company or business
  6. Valid  Identification Card/Passport/New driver’s license
  7. Proof of address (Utility bills, etc., obtained within the last 6 months)
  8. TIN Certificate
  9. Mine/Quarry Plan
  10. A transfer processing fee of US$500

Procedure 

  1. A transfer request is submitted to the Commissioner.
  2. The request is forwarded to the LMD for processing.
  3. AA/SAA Clerical verifies whether the Permit is in good standing before the processing of the transfer.
    1. If the Permit is not in good standing, the property holder is informed to correct the same before further processing.
    2. If the Permit is in good standing, the applicant is advised to pay a transfer fee of US$500.00
  4. Upon receipt of this fee, the mineral property file is forwarded to the Cartographic Section for verification and registration of the change in the Mineral Properties Database.
  5. The GIS reviewing Officer makes a recommendation for the next action.
    1. If the application is forwarded to the Registry Unit for preparation of Intention to Transfer, the Designated Clerk prepares the Intention to Transfer (refer to section 12 – Publication for details).
  6. Intention to Transfer is sent for publication in the Official Gazette, and a period of 21 days from the date of Publication is given for objection by the general public.
  7. After the twenty-one (21) day period for claims and the objection has elapsed, the AA/SAA Clerical informs the applicant to submit their copy of the Permit for endorsement of transfer.
  8. AA/SAA Clerical endorses both copies of the Permit and forwards it to the Commissioner through the LAM for signature.
  9. Upon return of endorsed Permits, AA/SAA Clerical informs the new Permit holder to uplift the same. 
  10. Permit holder uplifts Permit 
  11. Records and the database are updated.
