Overview
The Quarry License holder shall not be free to transfer the right in this License or any part thereof or share or create any interest whatsoever therein, without first obtaining the consent in writing of the Commission. This must, however, be stated in the License.
Who can apply for a QL?
- An individual who is a citizen of Guyana and an adult
- A company within the meaning of the Companies Act
- Any organization established by the Government or by or under written law in Guyana and authorized to carry on the mining operations.
Requirements
- A Quarry License holder(s) must submit an application in person to the Land Management Division requesting the transfer.
- Completed Form 9
- Transfer fee determined by the Commissioner
- Rental payment in good standing
- Environmental Bond
- Submission of relevant reports
- All required documentation (Who can apply for a QL?)
Procedure
- Upon receipt of the application for transfer, AO verifies whether the License is in good standing.
- If all conditions are not satisfied at this stage, the applicant is advised and allowed to submit additional information/make the rental payment.
- If all conditions are satisfied at this stage, AO informs the applicant to pay the transfer fee of US$500.00
- Upon receipt of the transfer fee, the application is forwarded to the Cartographic Section for registration and verification for the change in the Mineral Properties database.
- AO through the LAM forwards the application to transfer to the Mines Division for review to ensure all required reports about the QL are submitted and to verify the Technical and Financial capability of the transferee with respect to the proposed work Programme.
- If the Mines Division is not satisfied that the requirements have been met, the License holder(s) are notified in writing of such for the requisite action.
- If all requirements are met, the request is forwarded to the BOD for approval with the summary and the Mines Division’s recommendation. The same must be signed by the Mines Manager and the Commissioner.
- The BOD reviews the application.
- If the BOD approves the application, the designated Clerk prepares the ITT for publication.
- If the BOD does not approve the application, the applicant is informed of the decision in writing.
- In the case of 4 (a), ITT is endorsed by the GIS Officer and returned to the Registry Unit (refer to section 12 – Publication for details).
- ITT is sent for publication in the Official Gazette, and a period of 14 days from the date of publication is given for no objection by the general public.
- Following the objectionable period, providing that there are no objections, AO informs the applicant to submit their copy of the License for endorsement.
- AO endorses both copies of the Permit for the Commissioner’s signature. The same is forwarded to the Commissioner through LAM.
- When signed, AO informs the transferee to uplift the newly endorsed License.
- The new holder uplifts the License.
- Records and the database are updated.
